2nd WICAC Workshop (Antalya, Turkey, 12-18 May 2008)
“Review and validation of FAO/CIC draft legislative study on Developing Sustainable Wildlife Management Laws in Western and Central Asia”
The workshop was organized by FAO and the Turkish Forestry Department in collaboration with CIC to discuss a draft legislative study entitled “Developing Sustainable Wildlife Management Laws in Western and Central Asia.” The study had been conceived as a joint publication of FAO and CIC. The study was authored by two International Legal Consultants (Jim Wingard and Alessandro Fodella) and Elisa Morgera, with the research assistance of Anna Vartanyan.
The workshop was attended by around 30 participants (see list of participants) representing 10 countries, including those covered in the report as well as the Czech Republic, the Russian Federation and Turkey. Six representatives from a Central Asian project on wildlife management funded by the German technical cooperation (GTZ) also participated in the workshop. Plenary discussions as well as working groups (both in English and in Russian) were held for the participants to review the study in its entirety. Individual meetings between country representatives and the consultant were also organized on the sidelines of the workshop, to ensure the accuracy of the country profiles. Overall, the discussions confirmed the importance and timeliness of the publication, as well as the need for support to designing sound wildlife legislation in the region. They also highlighted the need to review in particular the principles related to sustainable use.
The workshop concluded with an indication from the Czech Republic representatives of their willingness to host in early 2009 a follow-up workshop for the launch of the study and the discussion of future activities. The final working sessions between FAO, CIC and GTZ aimed at clarifying the respective roles, activities and timelines for the finalization and publication of the legislative study, as well as for the identification of future joint activities.
With regards to future activities, the following ideas were discussed for future consideration:
- preparing an in-depth publication on priority wildlife legislation design principles (mostly focusing on participatory approaches to wildlife management), in light of the preferences expressed by the workshop participants. Similar experiences in the forest sector may be discussed at the 2009 follow-up workshop, with a view to formulating wildlife-specific principles as a result of the 2009 workshop discussion;
- developing a set of wildlife legislation design principles at a global, rather than regional, scale. This would entail the consideration of legal frameworks from countries in different regions of the world, as well as a discussion and validation workshop with participants from different regions. The publication of part I of the legislative study as a stand-alone working paper may be considered as a first step in this direction.
The workshop participants confirmed the usefulness of the publication, and provided thought-provoking feedback that will contribute to ensuring its quality and accessibility to legal and non-legal experts. It should be noted that some critical views were expressed by the workshop participants and organizers, in plenary sessions, about the effectiveness and usefulness of the international legal framework to ensure sustainable wildlife management at the national level, in particular with regards to limiting sustainable use for conservation purposes.
